Transfer of Najas
Assalamu alaikum Mufti Sahib,
I have a detailed question regarding najasah and the transfer of najasah according to Hanafi fiqh. The issue has effected me a number of times. I would be grateful if you could answer the exact scenario below.
I normally wash najas clothes as follows: First I remove the visible physical najasah from the clothes by applying brush etc.
Then I put the clothes in a clean bucket, turn on the tap continuously, and keep the clothes completely submerged while fresh water continuously enters the bucket and the excess water continuously flows out/overflows.
I then take the clothes out and wring the clothes, sometimes more , sometimes less
I was told by a Hanafi mufti that this is a valid method of purifying najis clothes. As running water is considered pure.
However many times this happens
I later discovered that an underwear garment had semen on it. The semen was not actually removed from the underwear during that process.
For the purpose of this question, please assume with certainty that the semen was physically still present on the underwear when I put it into the bucket, because I had mistakenly thought that I had already removed it.
My questions are:
1. Since the physical semen remained on the underwear throughout the washing, was the water in the bucket considered najis even though fresh water was continuously entering and the water was continuously overflowing?
2. If that water was najis, did the other clothes that were completely submerged in that water become najis, as the water itself was najas.
3. My main concern is what happened afterwards. At the time I did not know that semen was still present. I took the wet clothes out, wrung them by hand, handled them normally, and hung them out to dry. My hands were therefore in contact with the washing water and clothes. I then continued my normal activities for more than a week—touching my other clothes, doors, door handles, furniture, phone, bathroom items, my body, towels etc.
If my hands had actually become wet with najis water during the washing, Does najasah transfer from those wet hands to the dry or wet objects I subsequently touched.
Although Im aware of principles like transfer is established when there is actual transfer of the impurity, such as its colour, smell, or other discernible trace. Mere possibility or imagination isn't enough..
But in my case, najas was water itself.. So can't apply this principle.. If water itself was najas, how can I see if the colour etc.
I am specifically asking for the Hanafi ruling,
I am not asking whether I should simply wash the clothes again; I understand that I can do that. My main concern is the possible transfer of invisible najis washing water to my hands and subsequently to other objects in my home, office, etc
If such transfer is possible, how is a person supposed to establish which objects became najis when the najasah was invisible water and one cannot remember every object touched during the following days?
JazakAllahu khairan.
The flowing water in the bucket, as mentioned in your query, does not remain entirely impure (*najis*) at all times. Only the water that came into contact with the impure garment—and subsequently flowed out—would be considered impure (provided there was a noticeable change in its color, odor, or taste).
However, once the impure garment was removed from the bucket—especially given that fresh water was continuously flowing into the bucket while the existing water flowed out—the water in the bucket does not remain impure.
The garment mentioned in your query, which contained an impurity, must be washed again to ensure it is clean. Furthermore, since your hand became clean when you dipped it into the water in the bucket (after wringing out the impure garment) to wash other clothes, any items you subsequently touched with your hand have not become impure.
